Addressing Health Education and Diversion Program

The Addressing Health Education and Diversion Program is designed to help defendants who are facing criminal charges related to a substance abuse disorder. 

• Felonies 4 & 5
• Misdemeanors 1 & 2

1. Each applicant must meet eligibility criteria of R.C. 2935.36. Additionally: 
2. Applicant must be a Wood County resident. Out of county residents may be accepted on a case by case basis  
3. Applicant must not have a recent history of violent behavior or a pattern of violent behavior
4. Applicant must not have a history of mental illness that is beyond the scope of the treatment team’s capability to assist and address  
5. Applicant must not have a diagnosis of a developmental disability or cognitive impairment that would prohibit the offender from comprehending, participating, or complying with the Pretrial Diversion Program  
6. Applicants current and past criminal behavior is drug and/or alcohol motivated
7.  There is no evidence to support that the participant/offender has been involved in significant drug trafficking  
8. There is no evidence to support that the participant/offender has been involved in significant gang activities  
9. Applicant cannot be referred for a violation of R.C. 4511.19  
10. Applicant cannot be referred with a sexually oriented offense, as defined in R.C. 2950.01 (A)  
11. Applicant cannot be referred with any active holds or warrants from another jurisdiction  a. Participant/offender must not be charged or convicted with a crime any more serious than a felony of the fourth degree (F-4)  

Applications are completed between the defense attorney and the defendant. They are then sent to the ARC Program Coordinator by fax or email.
